JACKSON, Wyo. (CT) -- Jackson police say that demo derby streakers Seamus McKinney and Michael Smith were released from jail on bond yesterday and their court dates have been continued. Both men have been charged with misdemeanor child endangerment, which carries a possible fine of $1,000 and a year in jail. However, according to police, jailhouse and courthouse officials, for his scuffle and alleged injury of Teton County sheriff's deputy Todd Stanyon, McKinney also faces one felony count of interference with a peace officer causing bodily injury, a possible 10-year jail sentence.
A widely circulated Internet video of McKinney's nude sprint shows the streaker barelling into Stanyon and other security at the end of his dash. Stanyon has reportedly said that McKinney, after being told numerous times he was under arrest and ordered to put his free hand behind his back, resisted. Stanyon also reportedly said McKinney's failure to comply with numerous arrest orders is why he punched McKinney repeatedly with a closed fist in the rib cage. Stanyon sustained minor injuries to his right cheek and left knee in the melee, but he did not go to the hospital, according to Teton County Sheriff Bob Zimmer.
Video of the incident shows McKinney dropping his head before slamming into Stanyon and other security then Stanyon climbing on top and speaking to McKinney between body blows as other authorities arrive to assist in the arrest.
According to officials, McKinney has also been ordered by the court not to contact Stanyon. However, because he is a two-year Jackson resident with solid community ties, police say McKinney was released on a personal recognizance bond and Smith on a $1,000 "signature bond," which, they say, means he would only forfeit bond if he fails to appear at his next scheduled court date. In addition to the one felony charge, McKinney faces two misdemeanor counts of interference with a peace officer for a total of four charges, courthouse officials said.
Attempts to reach both McKinney and Smith for comment were unsuccessful Wednesday. Asked Wednesday afternoon if he would be representing McKinney, as rumoured, and could speak on his behalf, Jackson attorney and ex-judge George Kuvinka said, "No comment"
McKinney and Smith's next scheduled court dates are Aug. 10th at 8:45 am and 1:30 pm respectively in Jackson's 9th Circuit Court.
